What is a TCSP License?

A TCSP (Trust or Company Service Provider) license is a regulatory license issued by the Hong Kong Companies Registry under the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (AMLO).

Since March 2018, any person or entity providing the following services in Hong Kong must hold a valid TCSP license:

  • Company formation and incorporation services
  • Acting as a company secretary
  • Providing a registered office address
  • Acting as a nominee director or shareholder
  • Acting as a trustee of an express trust

Why Was the TCSP Regime Introduced?

The TCSP licensing regime was introduced to align Hong Kong with international anti-money laundering (AML) standards set by the Financial Action Task Force (FATF).

Licensed TCSP holders must implement rigorous Customer Due Diligence (CDD) and Know Your Customer (KYC) procedures, maintain proper records, and report suspicious transactions to the authorities.

The Risk of Using an Unlicensed Provider

Legal Risk
Engaging an unlicensed TCSP is an offence under Hong Kong law. Both the provider and potentially the client may face regulatory action.
Banking Risk
Hong Kong banks increasingly require evidence of a TCSP-licensed company secretary before opening a business account. Unlicensed providers may jeopardize your banking application.
Compliance Risk
Unlicensed providers may not follow proper KYC/AML procedures, putting your company at risk of being used for illicit purposes — with potential consequences for you.
Reputational Risk
Association with an unlicensed provider can damage your company's reputation with banks, business partners, and regulators.
